A wrongful death lawsuit alleges that the decedent was killed as a result of the negligence (or other liability) of the defendant, and that the surviving dependents, family members and/or beneficiaries are entitled to monetary damages as a result. Wrongful death suits differ from normal negligence lawsuits because, at "common law", the claim of an injured victim died with him or her. Thus, there was no claim that could be acted upon after the death. Over time, and in an effort to encourage responsible behavior, states enacted statutes to provide compensation for those who are damaged by the wrongful death. |
