Arbitration & Mediation
Arbitration & Mediation are two of the most common methods of Alternative Dispute Resolution (ADR). Mediation is one of the less formal alternatives to litigation that involves an impartial third party or panel (normally one or more licensed attorneys trained in negotiations) that intervenes to promote the resolution of the dispute or grievance. Whether the parties' reach an agreement through mediation is purely voluntary.
Mediation is used for a wide array of case-types: ranging from family law issues to juvenile felonies to Federal government negotiations with Native American Indian tribes or other disputing parties.
Arbitration tends to arise when previously agreed to by contract or required by statute. When binding, unlike mediation, the parties generally must accept the final determination of the arbitrator. If a party does not like or agree with the outcome of binding arbitration and refuses to comply with the arbitrator's decision, the other party can generally seek to enforce it through the civil courts.
